Das Amtsgericht Dortmund hat entschieden, dass bei der Wohnraummiete ein Anspruch auf Rückzahlung einer Mietsicherheit erst fällig ist, wenn dem Vermieter keine Forderungen aus dem Mietverhältnis mehr zustehen.
Im zugrunde liegenden Rechtstreit bestand zwischen dem Kläger und der Beklagten bis Juni 2016 ein Mietverhältnis über eine Wohnung. Bei Abschluss des Vertrages wurde eine Klausel vereinbart, nach der die Mietkaution zur Sicherung aller Ansprüche des Vermieters aus dem Mietvertrag dient. Weiter war geregelt, dass der Mieter, sofern der Vermieter sich berechtigterweise an der Kaution befriedigt, die Kaution wieder auffüllen muss. Weiter hieß es: “Die Kaution ist nach Vertragsende und Rückgabe der Mietsache zzgl. der Zinsen in angemessener Frist zurückzuerstatten, es sei denn, der Vermieter hat begründete Gegenansprüche, mit denen er aufrechnen kann oder die ein Zurückbehaltungsrecht begründen. Dies ist insbesondere der Fall, wenn und solange der Vermieter Ansprüche aus Neben- und Betriebskosten noch nicht beziffern kann.
Dem Vermieter steht gegenüber dem Mieter zurzeit weder aus der Kautionsvereinbarung noch aus § 812 BGB der geltend gemachten Kautionsrückzahlungnsanspruch zu.Der Anspruch war noch nicht fällig.
